General Provisions
This warranty applies to the original purchaser/occupier of the C&E Builders The warranty covers only those items listed. Items not listed are covered for 2 years under the ROC (Arizona Registrar of Contractors) guidelines or the manufacturer’s coverage.

The warranty covers normal use and does not apply or extend to properties that are used as Rental Properties or for Commercial purposes.
Warranty coverage begins from the date of completion of the work.
Covered items are repaired or replaced at C&E Builders’ discretion. The contract must be paid in full before C&E Builders coverage will be in effect.
Final payment shall not be held for the following items; warranty items, punch list items, final clean up, start-up and final inspections, We as the contractors will address and/or schedule these items once paid in full.
ITEMS COVERED BY C&E Builders
Interior Finish
C&E Builders warrants the original buyer for a period of 2 years for labor & materials on ALL interior finish materials (plaster, 3M, pebble, etc.) two-year warranty begins on the day 30 days after pool start-up. After the expiration of C&E Builders warranty, some products maintain their original manufacturer’s warranty for an extended period of time (from 3 years to 10 years). C&E Builders will contact the manufacturer rep for all warranty service & repairs, C&E Builders is not responsible for labor or materials after the original 2-year warranty. The owner must keep recommended water chemistry in order to maintain any C&E warranty. Failure to keep water balanced may result in premature failure of the interior finish & therefore void any & all warranties offered by C&E Builders. The owner may request “proper” water balance/chemistry guidelines from C&E Builders at any point during a 2-year warranty. If not given at the completion of the pool, C&E Builders will provide (upon request) a certificate of warranty for all of its interior finish products that explain the manufacturer’s warranties, contact info, etc.

C&E Builders is responsible for the repair or replacement of warranted items and equipment that malfunctions during the course of normal use. All workmanship warranties comply to and are regulated by the Arizona Registrar of Contractors. C&E Builders is not responsible to repair or replace any items or equipment which is damaged as a result of:
Improper repair work not performed by authorized C&E Builder personnel. This includes alterations, modifications, or additions made to the pool installation by anyone other than C&E Builders, including solar installations, salt systems, or your pool maintenance provider modifying our settings can cause services fees or a void in your pool warranty.
An owner’s failure to maintain or service their equipment as outlined in the owner’s manual or manufacturer guidelines, including the failure to take care of, or maintain, the proper chemical balance of the pool water. Missing parts, structural damages to pool by other incidents, fire, electrical failure or surges, water damage, lightning, mud, earthquakes, storms, freezing, accidents, pest damage, or Acts of God. Damages caused by customer neglect. Any changes to or around the pool by the owner, including deck or landscape that affect drainage away from the swimming pool or structure. Changes that constitute a violation of current building codes and could affect the swimming pool installation. C&E Builders does not warranty any work done, or provided by an owner, an owner’s agent, or C&E Builders referred 3rd party licensed contractor who is dealing direct with an owner. C&E Builders shall not be liable for any loss or damages that take place to the shell, decking, tile, or other pool products, from landscape drainage not done property by an owner (around the pool) after the pool is completed.
C&E Builders is not responsible or liable for incidental or consequential damages of any kind that can or may occur from the use, ownership, or purchase and installation of the pool. C&E Builders is not responsible for the replacement or repair of normal wear and tear items such as skimmer weir door, pump lids and basket(s), rubber gaskets or O-rings, filter pressure gauges, D.E. Filter grids; Sand Filter media; light bulbs, remote control batteries, the deck expansion joints, deck-a-drain wear or damage from Arizona heat and UV. Items covered are specified and listed in the coverage above.
Electrical Items

Pool Tile
2-year Warranty – The warranty is limited and begins on the date of pool start-up. The pool tile warranty includes the waterline tile, raised beam tile, and water feature tile installed over the shotcrete shell (excludes chemical or salt damage, freezing, cracking, fading, fogging, mineral deposits, or any type of staining resulting from fluctuations in water balance).
C&E Builders should repair loose grouting or cracks in grouting one time within the first 12 months
Brick / Fireplace
- Builder shall repair cracks in mortar and lose bricks ONE (1) TIME ONLY during the 2-year Warranty Term.
- C&E Builder shall specifically not be responsible for
discontinued patterns or color variations or motar patching materials. - Unfortunately, we cannot guarantee that your home or any area of your property will stop moving. If your home continues to move, the cracks may come back. Ignoring the repair will only make things worse because the cracks will grow, brick or stone will loosen, and your home will begin to fall apart. It is important to continue the maintenance on your home because even if cracks reappear, you are holding the home together by continually re-pointing the mortar, which sometimes must be done annually.
Guidelines:
C&E Builders will cover all materials and labor required to correct any defect in workmanship that is covered under this warranty. C&E Builders will replace any components that are proven to be defective due to workmanship only. We do not guarantee any materials but can assist in helping with contacting manufacturers and providing proof of purchase if required. This warranty covers installation errors only and not actual products used.
Landscape
- All plants material is guaranteed for 30 days from the date of installation. The warranty does not cover damage due to improper watering, fertilizer, or maintenance, which is solely the responsibility of the client. C&E Builders extends the warranty period for 15-gallon plants/trees or larger for an additional 60 days (90 days from day of installation). C&E Builders’ final decision in warranty and replacement of dying or dead material. During winter months & summer months, C&E Builders will guarantee deciduous & winter dormant plants until spring bud-out (Absolutely no warranty for FREEZE damage).
- Borders have a 30-day warranty.
- All granite-covered areas will be fine-graded only (raked), we are not responsible for drainage grade unless otherwise specified.
- Low-voltage landscape lighting has a 90-day warranty on the lights and transformer. Blown light bulbs are not covered under warranty.
New Lawn or Sod Installation
The limited warranty period is six (6) weeks from the completion of the lawn hydroseeding and/or sod installation. If you notice areas where the roots have not been established after Week 3, please contact us as soon as possible, well before the end of Week 6, to schedule additional service to those areas. After our follow-up service, your lawn/sod should be well-rooted, established, and mature by the end of Week 6, the conclusion of the limited warranty period.
Any areas where growth has not occurred, after the limited warranty period, is likely to be evidence of a different problem or issue related to other ground or ecological conditions, unrelated to the lawn/sod installation process.
Irrigation
The Irrigation warranty is limited and begins on the completion date of the installation or repair. We fully support and stand behind our products and services. We provide a 1-year limited warranty on all workmanship of new irrigation installations. We provide a 1-year limited warranty on all new drainage installations including parts and labor. We provide a 30-day labor warranty on all service repairs.it is necessary to check the drip and sprinkler heads for proper water flow on occasion, especially a new system. Drip lines can get clogged by tiny particles of dirt and must be cleaned out. This can be done by taking off the end cap and letting the water flow freely and then replacing the end cap/emitter.
Exclusions:
Damage to the product or system that occurred by accident, neglect, excavations, abuse, or acts of God. This guarantee and limited warranty does not apply to any defects or insufficiencies resulting from a decrease in water main static pressure, changes to landscaping, changes to plant growth, and/or increases and decreases in the size of the customer’s lot.
During the warranty period, if another contractor or company other than C&E Builders performs work on the system installed by C&E Builders, the warranty is considered void.
Please be aware that when a repair is made, the repair itself is considered complete. We do not warranty unrelated problems that can surface after we leave.
Concrete
All concrete is warranted for 2 years -The warranty is limited and begins on the completion date of the installation. Small imperfections can and will be expected. No warranty is expressed/implied regarding the cosmetics of the repair. The subject’s appearance will be considered secondary to it’s long-term functionality and durability. Concrete can be damaged by many factors beyond C&E Builders’ control. Damage from wear and tear, chemicals, equipment, vehicles and other things are out of C&E Builders’ control and are not covered by this Limited Workmanship Warranty. C&E Builders is not liable for repair conditions caused by misuse or abuse, ground settlement, weather conditions, accidents or acts of God. This warranty does not apply to, and is waived by the homeowner as to, any construction work that has been subjected to an accident, misuse, and/or abuse, nor does it apply to any construction work that has been modified, altered, defaced, and/or had repairs made/attempted by the homeowner or others. This Limited Workmanship Warranty expires one year from the date of completion of the project.
WHAT TO EXPECT:
CRACKS – Concrete WILL crack. We don’t like it either but it will happen so we CANNOT guarantee that concrete will not crack, even in spite of all precautions having been taken. If a crack appears, we may be able to assist in the prevention of further cracking. The industry standard for repair or replacement for cracked concrete is greater than ¼” of an inch displacement either in height or gap. Cracks that exceed ¼” of an inch in height or gap may warrant repair or replacement. If we determine that repair or replacement is required, we will replace or repair only the affected area. Repair of concrete cracks with caulk or mortar will be considered an acceptable form of repair. PLEASE NOTE: Surface or hairline cracks may not be covered. Topcoats and caps over existing concrete are NOT covered.
FLAKING or POPPING: While concrete is very durable, it is not always without flaws. Harsh weather may cause the surface of your concrete to flake or pop-off. It is possible that a stone or stone(s) close to the surface will be exposed but such exposure WILL NOT compromise the integrity of the slab. We are unable to warranty any damages caused by harsh weather as mother nature always has the upper hand on us. The industry standard for repair or replacement for flaking or popping concrete is a minimum of 20% of the total work area being affected. Depending on the issue, we may warranty flaking or popping concrete if 20% or more of the total work area is affected. If repair or replacement is required, we will repair or replace only the affected area.
DISCOLORATION: It is NOT possible to match the color of your existing porch, sidewalk, driveway, BBQ, firepit, etc. Sometimes different pours on larger jobs are subject to variation in color. Color variations are minor and may fade within time. If you are considering replacing only a section or sections of an existing driveway, patio or sidewalk, please be aware that a color difference is very likely (newly poured section vs. older section). It may be very noticeable and may take years to blend together. Gray Concrete can make no warranty that our work will match your existing product.
EFFLORESCENCE:
The potential for efflorescence exists in all portland cement-based products.
Efflorescence is a salt that is left on the surface of concrete upon drying and is generally of only cosmetic concern in nature. It often dissipates with contact with water or the passage of time. Efflorescence that is severe, recurring, or accompanied by degradation of the concrete surface may indicate the application of excessive moisture, an elevated concentration of salts in the applied water, numerous cycles of wetting and drying and/or a more substantial presence of salts within the surrounding environment.
COLOR’S
Colors represented on a computer screen or a printed brochure are just a representation of results and should not be relied upon for the final color of your project. Despite our best efforts, the minor discoloration can still occur. There are a variety of different factors (such as variations in a slump, cement type/brand, finished texture, the timing of operations, the curing process, choice of release agents, surface treatments, humidity and other weather conditions, age of concrete, etc.) that can and may produce distinct variations in color appearance. Color variation is not covered by this warranty.
SHIFTING and SETTLING:
It is common for driveways, sidewalks, porches, patios, BBQ tops, fire pits and garage floors to have some cracking or shifting over time. This is not necessarily a sign of poor workmanship. There is no way for us to prevent sub-grade settling, underground root growth or shrinkage of the subsurface layers. We CANNOT warranty against settling because the sub-grade level is beyond our control.
FINISHES:
Interior surfaces are generally finished smooth (basement floor, garage, sometimes porches and patios). A smooth finish allows for easy maintenance. Please be aware that smooth finishes are VERY slippery when wet. Exterior concrete such as walks and driveways are broom finished. A broom finish is less slippery and designed to be walked upon even when wet. Stamped surfaces and stained surfaces are sealed to help maintain the beautiful characteristics of the color and design. The sealer used will cause a slippery surface when wet. Please view the information provided below regarding the use and importance of sealers. Additionally, surfaces which are stamped or stained will require maintenance; how frequently is out of our control.
CUSTOMER CARE:
THE DO NOT’S: 1) Do not drive on or use the “new” concrete for at least 10 days. 2) Do not allow water to drain beneath the slab as this may cause settlement cracks. . 3) Do not allow your dog’s urine (on your decorative concrete) Dog urine is extremely acidic and can cause damage to your decorative concrete. We recommend cleaning it as soon as you witness it.
RE-SEALING CONCRETE:
It is important to note that we do not warranty sealer-related failures. Surface maintenance is out of our control as heavy traffic, heavy use and severe AZ heat may and can negatively influence the performance of the sealer. The care and maintenance of concrete are the homeowner’s sole responsibility. The frequency with which you should reseal your concrete will depend on the area’s exposure to cars, foot traffic, and any chemicals the decorative concrete is exposed to such as chlorine, saltwater, stabilizer, and the like. We highly recommend that stamped concrete, concrete BBQ tops, and concrete Fire pit projects be kept clean and resealed every other year or as needed. The longer you wait, the more likely you may notice the surface color fade slightly. Keeping a fresh coat of sealer will protect and keep the color as vibrant as the day it was installed.
THE RESEALING TEST: To determine if you need to reseal you concrete, sprinkle water on the concrete surface. If the water is absorbed and makes the surface noticeably darker, the sealer has worn off and resealing the project will restore its original beauty. If the water is not absorbed and beads on the surface, the concrete should still be protected and likely does not require additional resealing.
Concrete ONE YEAR Limited Warranty
Limited Warranty: For one year, commencing from the completion of your project, there will be no “Major Cracking,” “Major Scaling and Spalling” or “Major Popout” due to defective materials or workmanship. For this warranty to be effective, all concrete must be at least 6 bag mix 4000psi, Air Entrained, with the “Euclid Barricade 200 Penetrating Sealer” option, that is provided on all exterior concrete projects. Exterior concrete projects that are not sealed by C&E Builders are not covered in our one-year limited warranty.
Definitions: “Other exterior concrete” includes patios, sidewalks, BBQ tops, fire pits and other exterior flat work. “Major Cracking” means cracks wider than ¼ inch that: *in total length, are more than 30% of the length of all of the joints in your driveway or other exterior concrete; or * in any parcel, the total length is more than 30% of the perimeter length of the panel. “Major Scaling and Spalling” means any substantial surface disintegration that occurs at the surface of the driveway or other exterior concrete that covers more than: *20% of the surface area of your driveway or other exterior concrete; or *25% of any panel of your driveway or other exterior concrete. “Major Pop out” means more that 50 conical breakouts per 100 square feet in the concrete surface from fractured pieces of aggregate.
Exclusions: This limited warranty does not apply to damage resulting from *abuse of your driveway, firepit, BBQ top or other exterior concrete *not any purpose other than residential purposes *fire, flood, expansive soil, earthquake, defective subsurface or other act of God * altering areas near your driveway, firepit, BBQ top or other exterior concrete so that drainage or water runoff undermines your driveway or other exterior concrete * the growth of trees (including roots) or plants near your driveway or other exterior concrete * Scaling , spalling or pop outs other than major scaling, spalling or pop outs *Contact between your driveway or other exterior concrete and vehicles, foreign objects, animals or persons (other than contractor) during the 10 day period after your driveway or other exterior concrete is installed *Cracks other than major cracks *discoloration or stains * any settlement or shifting from installation or repair of utility trenches near your driveway or any other exterior concrete at the point where it meets a garage or car port slab. Also, uniformity in the color of a driveway, firepit, BBQ top or other exterior concrete may vary within the same pour or when repaired or replaced. This warranty will not guarantee uniformity in color.
Remedy:
A. If you think that your driveway or BBQ top, firepit or other exterior concrete has Major Cracking. Major Scaling and Spalling, or Major Pop outs due to defective materials or workmanship, you must notify your Contractor in writing. IF YOU DO NOT NOTIFY THEM WITHIN 90 DAYS AFTER YOU DISCOVER MAJOR CRACKING, MAJOR SCALING AND SPALLING, OR MAJOR POPOUTS, YOUR LIMITED WARRANTY RELATING TO THAT CONCERN IS VOID. TELEPHONING WILL NOT PRESERVE YOUR RIGHTS.
B. Inspection: Once your Contractor receives notification, your driveway, firepit, BBQ top or other exterior concrete will be inspected by your Contractor or representative within 30 days to determine if Major Cracking, Major Scaling and Spalling, or Major Pop out has occurred due to defective materials or workmanship.
C. Repair or Replacement: If Major Cracking, Major Scaling or Spalling or Major Pop out, which is the subject of the notice, occurred within 1 year of the completion date due to defective materials or workmanship, the Major Cracking, Major Scaling or Spalling or Major Pop outs will either be repaired or the damaged part of your driveway, Firepit, BBQ Top or the exterior concrete will be replaced. This will be carried out at no charge to the homeowner. Your Contractor will have the right to choose between repair or replacement.
No Other Warranties: There are no other warranties, expressed or implied concerning your driveway or other exterior concrete.
Transfer: This Warranty is non-transferable
Transfer Provisions and Limitations
C&E Builders warranty is valid only to the original purchaser.
Hardscape
C&E Builders offer’s a two-year workmanship guarantee from the date of installation on all residential hardscape projects. We offer one-year workmanship guarantee on all commercial projects. Many of the materials we use are backed by their own guarantees and warranties also when properly installed.
Guarantee and warranty policy:
All follow-up maintenance was followed by the homeowner as recommended after installation by C&E Builders.
Normal wear and tear on the patio or hardscape area or excessive traffic and abnormal weight not specifically stated prior to start of project such as a hot tub being placed on patio without prior consultation with C&E Builders.
DIY (do it yourself) options are not covered under any guarantee/warranty policies: this includes but not limited to projects started but not completed by C&E Builders or projects finished but not started by C&E Builders.
C&E does not cover polymeric joint
Cracked Paver(s) is not covered under warranty
Any work or alterations completed by the client after completion of the project such as negligent maintenance or additions/alterations that have been made to the original deck without proper consultation. Any alterations made by the client or other outside contractors will result in the cancellation of any guarantees or warranties.
Unfortunate natural occurrences such as storm damage, flooding or other acts of God, vandalism, animal or fire damage.
Settlement resulting from the placement or compaction of soil by another contractor or homeowner will not be covered.
Pavers or wall units placed on existing concrete surfaces (i.e. patios, walks or steps) as a result of client’s request will not be repaired under this warranty. If C&E Builders and the client decide to use a concrete base that is not applicable here and is covered under the warranty for two years.
Exact color matches of stones are not guaranteed.
White substance on paver stones (efflorescence) is a result of a naturally occurring reaction and is not a defect therefore will not be covered. Staining, discoloring and or rusting on the paver is also not covered.
C&E Builders only guarantees the scope of work that is stated in the proposal.

Responsibilities of C&E Builders
If we are requested to build in a manner that we do not recommend or is not to current code standards, that scope of work will not be covered under workmanship guarantee.
During construction, due to heavy foot traffic or equipment, there may be minimal damage caused to your lawn and driveway. Turf and driveway repair is NOT included in the price and will be subject to a change order or additional costs if repair(s) are requested. We do take every precaution to ensure your property is protected.
C&E Builders is not liable for damages caused by other contractors or delivery trucks. We are also not responsible for any materials, purchased by client, that are left unattended on property. Please safe guard materials by storing in a safe location before and during construction.
The warranty DOES cover things such as faulty cuts, defects caused during installation and any problems that you may have resulting from our workmanship.
C&E Builders is not be liable for delays due to unforeseeable causes beyond the control of, and without the fault or negligence of the contractor, including acts of God, acts of the homeowner, fires, floods, strikes, freight embargoes, severe weather, material unavailability, material theft or inability to obtain materials. These delays do not constitute abandonment and are not included in calculating time frames for payment or performance. Delays beyond our control may also delay a start date or completion date. Change orders may also delay the timeline of your project.
Our contracts do not include hidden or unknown contingencies such as but not limited to: concealed pipes, rotting or decay, foundation depths in excess of 30 inches, relocation of underground utilities. Should rock or other hard or similar material be encountered in the footing or any excavation, such as post holes, which require the use of a compressor, blasting material or unusual method, to remove the hard material, the extra cost will be billed as a change order and due as specified. Extra labor costs are billed at the rate of $35.00 per man per hour. In the event unexpected equipment rental is needed and is not in the signed proposal, the customer is responsible for payment of rental and to be paid by customer prior to renting equipment. Change orders are to be paid in advance of any work performed or invoiced at the end of job; this will be determined by C&E Builders on case by case basis. If there are changes to the original scope, necessitated by zoning and or building inspector requirements or customer initiated changes that require a change in the permit, the homeowner will be charged for the drawings, time to run the permit and any county or city fees. Change orders may affect the projected completion date. Typically permit revisions are $160.00 and will be billed as a change order. Specifics regarding certain materials/projects: o Pavers:
Settling or heaving of stoops or steps within a two year period C&E to make all repairs in this instance. Warranty excludes areas of settling due to expansive soil.
Pavers should not deteriorate to the extent that the aggregate is exposed or the aesthetics are destroyed under normal wear and tear then All C&E Builders should take corrective action necessary to replace defective areas. C&E Builders out will not be responsible for damage caused by chemicals, excessive washing or abuse.
Excessive ponding or standing water on patios, stoops, walks or driveway and backyard surfaces should not be the case after installation unless the client has not followed the advice of C&E Builders on grading and installation of gutters. Water should drain; if does not then we should make necessary repairs to correct it.
Shifted or broken edge restraint – edge restraints should remain stationary so C&E Builders should make any necessary repairs.
Excessive gaps over 1/4″ should be addressed by C&E Builder and covered by warranty. White substance on pavers (efflorescence) can’t be warranted against because it is a naturally occurring reaction and not a defect. No action will be required by C&E Builders if this occurs.
Retaining Walls/Masonry:
Masonry walls should be straight, plumb and level. Slump blocks will absorb moisture and should be sealed to prevent leaks through wall and damage in freeze-thaw zone. This is a regular maintenance that will be client’s responsibility after installation.
Crooked, out-of-plumb, out-of-level masonry walls must be repaired by C&E Builders if found to be that way after installation –specifically ¼” out-of-plumb, ½” in total length of wall out of level not to exceed ¼” in 10’ unless specified in scope of project.
Uneven surface of masonry walls should be free of protruding or sunken blocks or bricks unless called for in the plans for project – will be repaired by C&E Builders if found to be this way after installation.
Cracks in mortar joints can result from normal settlement and do not necessarily indicate a structural problem. Cracks 1/8” or more should be filled. If cracks exceed 1/8” or if crack extends across the block itself, a structural problem may exist. C&E Builders should come out to assess the cracks and make the appropriate repairs if necessary.
Masonry columns should be plumb ¼” and in line within ¼”. C&E Builders would need to make appropriate repairs if needed.
Artificial Turf
C&E Builders warrants our synthetic turf for ten (10) years from the date of synthetic turf installation when it is installed and maintained as recommended by the turf manufacturer. If any area or portion of the turf substantially changes, as distinguished from a change in texture within ten (10) years after its initial installation, C&E Builders will have all such areas or portions replaced, excluding installation costs. C&E Builders also warrants that at the time of the initial turf installation, the synthetic turf will be free of manufacturing defects. Slight color changes will occur over the lifetime of this turf and are not considered an issue or basis for a claim. All labor costs involved with the removal of the affected turf and reinstallation of the replacement will be the responsibility of the purchaser not the installation company nor is it the responsibility of the manufacture. Subject to the following limitations:
General provisions of this limited warranty apply to the wear of the turf with regard to ultraviolet degradation, and do not apply to damage incurred during installation, improper underlay, pile crushing, willful or negligent abuses, or damage by machinery or equipment, nor does it apply when the turf is not installed by a professional installer. The expressed limited warranty excludes all implied warranties, and said manufacturer shall in no event be liable for a breach of the warranty in any amount exceeding the invoice price of the turf.
Limitations on Coverage:
This warranty does not cover:
Damage from accidents, vandalism, abuse, and neglect.
Acts of God (including earthquakes, floods, expansive soil, and other natural disasters). Use of chemicals and improper cleaning methods. Failure to properly maintain, protect and/or repair the turf. Damage caused by reflection (melting) or other flammable materials. Synthetic turf is subject to normal wear and tear. Normal wear and tear is not a manufacturing defect and therefore is not covered by this warranty.
Metal Work / Powder Coating
All fence components manufactured with galvanized steel and the use of powder coatings are warranted against defects in materials and workmanship for 1 year. All other coatings (textured, special colors, etc) are warranted for a period of one year. Components requested using raw steel or cast iron are not warranted against rust for any period.
All installation work performed by C&E Builders is warranted for 1 year from the original purchase date as shown on the invoice.
The following acts and/or omissions will void the warranty:
-Contact with salt water, magnesium chlorides, ice melt
-Contact with chlorine, fertilizer pesticides, or industrial chemical agents
-Contact with sprinkler systems, tree sap, entangled vegetation
-Alteration of coating by owner or agents of owner
-Physical damage due to acts of God
How to Submit a warranty:
WARRANTY CALLS: The homeowner must notify C&E Builders of a malfunction of any warranted item by using the request form below or by email at warranty@cebuildersaz.com as soon as a problem is found. A service call, or inspection, will be made by an authorized C&E Builders employee.
